General Terms and Conditions of Sale (GTCS)

1. Scope of application
These general conditions apply to all orders placed in the online store (shop) of Algorigin AG, Route des Jeunes 9, 1227 Acacias (Geneva), tel. +41 (0)22 552 01 25, info@algorigin.com, www.algorigin.com, IDE: CHE-456.417.288 (hereinafter: “Algorigin” or “the seller”) by customers domiciled in Switzerland or in the principality of Liechtenstein.
2. Offer and conclusion of the contract
- The presentation of the products in the online store does not constitute a legally binding offer to Algorigin but an invitation to the customer to place a binding order (offer to conclude a contract).
- By clicking on the [Acheter maintenant] button, the customer places an order which binds him to the products appearing on the order page.
- Algorigin acknowledges receipt of the order by email immediately after receiving it. The sales contract is only concluded when the seller confirms the dispatch of the goods by email (order or dispatch confirmation) or, at the latest, when the goods are delivered.
- In case of payment in advance (prepayment), the sales contract is concluded when the seller confirms receipt of payment.
3. Price
- The prices indicated are in CHF and all taxes included, excluding shipping costs. They may be subject to change. The items ordered are invoiced on the basis of the price in effect at the time the order is placed.
- The price is payable in full and in a single payment when ordering. All orders are invoiced in CHF and payable in CHF.
4. Availability
The products are offered as long as they are visible on the site www.algorigin.com. In the event of unavailability of products after placing the order, the customer will be informed by email.
5. Payment Terms
The customer can pay for their order:
- by credit card in the Shopify Payments environment without opening an account and in a secure manner.
- by PayPal account.
- by bank transfer with a QR-bill
6. Late payment / reminder / collection
- In the event of delivery with invoice, the sales price is due within 30 days from receipt of the goods. The customer who does not pay within this period is in default.
- The seller sends three written reminders to the customer in default. The following fees are due in the event of a recall:
- Invitation to payment after ten days late: 0 CHF
- 2nd reminder after 25 days late: 0 CHF
- Last reminder after 40 days late: 10 CHF
7. Retention of title
The goods remain the property of the seller until full payment. It is prohibited to pledge, transfer as security, transform or modify the goods without the consent of the seller before the transfer of ownership.
8. Guarantee
- The seller guarantees the elimination of defects in the goods. He can, at his choice, eliminate a defect (repair) or deliver a thing free of defects (replacement delivery).
- If the elimination of defects fails, the customer is entitled to withdraw from the contract. This provision is not applicable to insignificant defects. A right of the customer to a price reduction is excluded.
9. Liability
The seller excludes liability for breaches of contract caused by slight negligence. The same applies to contract violations committed by auxiliaries and sub-agents.
10. Intellectual Property
All the elements of the site www.algorigin.com are and remain the intellectual and exclusive property of the company Algorigin SA. No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the company Algorigin.
11. Data Protection
The seller undertakes to process the customer's data in compliance with data protection regulations. Further information on the processing of customer data can be found in the seller's separate data protection declaration. This can be consulted at any time on the Personal data management and cookies policy site.
12. Archiving
- Algorigin will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy.
- The computerized records at Algorigin will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
13. Applicable law
The language of this contract is French. These conditions of sale are subject to Swiss law. In the event of a dispute, the Swiss court in Geneva will have sole jurisdiction.
14. Final provisions
The ineffectiveness of a provision of these general conditions does not affect the validity of the contract. The ineffective provision is replaced by the relevant legal provisions.
